GENERAL TERMS AND CONDITIONS OF THE BENEFIT PASS PROGRAM


  1. GENERAL PROVISIONS
    These General Terms and Conditions govern the rights and obligations between Key4you j.d.o.o. (hereinafter referred to as the "Issuer") and the user of the Benefit Pass digital card (hereinafter referred to as the "Cardholder").
    By purchasing, activating, or using the Benefit Pass card, the Cardholder confirms that they have read, understood, and fully accepted these Terms and Conditions.
    The Issuer reserves the right to amend, supplement, or revoke these Terms and Conditions at any time without prior notice. The current version shall always be available on the official website.

  2. DEFINITIONS
    Issuer – Key4you j.d.o.o., the owner and operator of the Benefit Pass Program.
    Partner – any legal entity or natural person participating in the Benefit Pass Program pursuant to an agreement and providing benefits to Cardholders.
    Cardholder – any legal entity or natural person who has purchased or lawfully uses an active Benefit Pass card.
    Benefit Pass – a digital benefits card that enables the Cardholder to obtain certain discounts, benefits, or special offers from participating Partners.
    Benefit Pass is not a payment card, electronic money, a financial instrument, nor does it constitute or replace any means of payment.

  3. PURPOSE OF THE PROGRAM
    Benefit Pass enables Cardholders to obtain discounts, benefits, and other advantages from participating Partners.
    The Issuer does not provide accommodation, hospitality, tourism, transportation, healthcare, sports, or any other services offered by the Partners.
    All services, products, and benefits are provided exclusively by the respective Partner, who bears sole responsibility for their quality, safety, legality, availability, and proper performance.

  4. PURCHASE AND ACTIVATION
    The card may be purchased exclusively through the Issuer's official sales channels.
    The card becomes active upon successful payment and delivery to the Cardholder.
    The Issuer shall not be liable for delays caused by internet service providers, banks, payment processors, telecommunications operators, or any other third parties.

  5. CARD VALIDITY
    The card shall remain valid for the period specified at the time of purchase.
    Upon expiration of its validity period, the card shall automatically expire without prior notice.
    Unused benefits may not be carried over to any subsequent validity period.
    The Benefit Pass must be activated no later than twelve (12) months from the date of purchase.
    If the Cardholder fails to activate the Benefit Pass within the aforementioned period, the card shall automatically expire, and the Cardholder shall not be entitled to a refund, extension of validity, or the issuance of a replacement card.

  6. DISCOUNTS AND BENEFITS
    The displayed discounts, benefits, participating Partners, locations, and terms of use are provided for informational purposes only.
    Partners independently determine:
    the availability of services;
    periods during which benefits may be used;
    seasonal conditions;
    special promotional offers;
    capacity limitations; and
    reservation requirements.
    The Issuer does not guarantee that any particular benefit will be available at all times.
    Discounts and benefits may vary depending on the season, availability, promotional offers, or business decisions made by the Partner.
    A Partner shall have the right to refuse the application of a benefit if the Cardholder is unable to prove possession of a valid and active Benefit Pass card.

  7. LIMITATION OF LIABILITY
    To the fullest extent permitted by the applicable laws of the Republic of Croatia, the Issuer shall not be liable for:
    the quality of services or products provided by Partners;
    injuries, accidents, losses, or damages occurring at Partner premises or in connection with Partner services;
    omissions or failures of Partners;
    reservation cancellations;
    overbooking;
    delays;
    price changes;
    dissatisfaction with services provided by Partners;
    loss of profit;
    indirect damages;
    incidental damages; or
    consequential damages of any kind.
    Any complaints relating to a Partner's products or services must be submitted directly to the relevant Partner.

  8. CHANGES TO THE PARTNER NETWORK
    The Issuer reserves the right, at any time, to:
    add new Partners;
    remove existing Partners;
    modify discount levels;
    amend the conditions for using benefits; and
    temporarily or permanently discontinue specific benefits.
    Such changes shall not constitute grounds for a refund.

  9. REFUNDS
    Once the card has been activated, the Cardholder shall not be entitled to a refund, except where expressly required by mandatory provisions of applicable law.
    Failure to use the card shall not constitute grounds for a refund.
    Dissatisfaction with Partner offers, changes to benefits, or changes within the Partner network shall not constitute grounds for a refund.
    10. FORCE MAJEURE
    The Issuer shall not be liable for failure to perform its obligations due to events of force majeure, including, but not limited to:
    natural disasters;
    fires;
    earthquakes;
    floods;
    epidemics;
    pandemics;
    war;
    terrorist activities;
    cyberattacks;
    internet outages;
    disruptions to energy supply; and
    decisions of governmental authorities.

  10. INTELLECTUAL PROPERTY
    The content of the website, including logos, names, photographs, texts, graphic design, databases, and all other elements, constitutes the intellectual property of the Issuer or its Partners.
    Any unauthorized copying, reproduction, distribution, publication, or use is strictly prohibited without the Issuer's prior written consent.

  11. DATA PROTECTION
    The Issuer processes personal data in accordance with the applicable laws of the Republic of Croatia and Regulation (EU) 2016/679 (General Data Protection Regulation – GDPR).

  12. PREVENTION OF MISUSE
    The Issuer reserves the right, without prior notice, to:
    deactivate a card;
    temporarily suspend a user account;
    refuse access to benefits,
    where there are reasonable grounds to suspect:
    misuse of the card;
    submission of false information;
    unauthorized use;
    fraudulent activities; or
    violation of these Terms and Conditions.
    In such cases, the Cardholder shall not be entitled to compensation, damages, or a refund.

  13. GOVERNING LAW AND JURISDICTION
    These Terms and Conditions shall be governed by and construed in accordance with the laws of the Republic of Croatia.
    The parties shall endeavour to resolve any dispute amicably.
    If an amicable settlement cannot be reached, the competent court having jurisdiction at the registered office of the Issuer shall have exclusive jurisdiction.

  14. FINAL PROVISIONS
    Should any provision of these Terms and Conditions be held invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect.
    These Terms and Conditions shall enter into force on the date of their publication on the Issuer's official website and shall remain valid until amended, revoked, or replaced by a new version.
